I would suggest an even simpler explanation,
If there is nothing they've observed to prevent the star from consuming the planet, then there is something they haven't observed. This could be as simple as a magnetic field that protects the planet from the erosive power of the stellar wind that close. A larger than normal metal core or a faster than normal rotation could explain such a magnetic field.
To say we've found ONE planet that doesn't appear to follow the rules of physics more likely means the observers are missing something, or our interpretations are flawed,
not that the laws are flawed.
