Actually, she *DID* file a suit against Wendy's.... but dropped it after police searched her house & started looking into her background (someone close to her, either a neighbor or a relative.... had called in a report that the finger might have come from the woman's aunt, who had died recently).
What it sounds like, IMO, is that she planted the finger hoping for a quiet, fairly fast settlement (similar to the one she'd gotten after her daughter had gotten sick at a restaurant)...... and then got nervous and started backing out when Wendy's didn't cave in immediately & she started being investigated.
