<HTML>A Lurker
I have always lurked and never posted before,
but I thought that Mr. Anthony is in desparate
need of some advice.

++In light of two recent actions by yourself,
++they being, 1) Admitting to contacting Dr Kate
++Spence with slanderous intent, and
+
+HUH? Duncan has never slandered Kate.
My interpretation of this is that Mr. Anthony is
suggesting that Dr. Kate was contacted in an
attempt to slander him. Proving slander is going
to be difficult without having Dr. Kate involved and
willing to cooperate. Mr. Anthony might want to
consider that 1. Dr. Kate is not going to be a happy
camper if she gets drawn into this lawsuit even as
a witness and has her time wasted over this silly
stuff and 2. certainly not going make him any friends
among either avocational or professional
archaeologists with this suit.
People who are quick to resort to lawyers to settled
their personal differences find themselves quickly
avoided and ignored, except in the most blatant cases
where the person sued had it obviously coming to
him / her. Regardless of whether a person is right or
wrong, lawsuits of this type are no win situation for
most people. The main effect of such a suit will be to
make people simply afraid to discuss anything with a
person out of fear that the person might sue
anybody who disagrees with him or her. Threatening
people with childish and frivelous lawsuits, like some
schoolyard bully, that are looney to the point of being
laughable will do more damage to a person's reputation
than anything that Duncan can say.
In another post, Mr. Anthony posted:
+2) Posting exerpts from a letter that expilicitely
+warned you NOT to - in whole or IN PART,
This has nothing to do with slander rather with
copyright which can be very difficult, if not impossible
to do, as some sort monetary damages have to be
eventually shown from the unauthorized usage of
the letters. With personal letters, the best a friend
of mine could do was get a cease and desist order
against further publishing of the letter. Even if the
contents of the letter was embarrassing, there is no
slander involved as long as the the content of the
published letters was true and unaltered. If they
were some famous person's long lost letters and their
content worth money on the open market, then there
might be a case for damages, otherwise, the best
that a person can hope for is a simply cease and
desist.
I will resume lurking again and watch as Mr. Anthony
makes a complete and utter fool of himself with his
lawsuit.
A Lurker
P.S. I know of one lurker, ***not me***, who has already
emialed Dr. Kate warning her not have to do anything
with Mr. Anthony because of his threatened lawsuit.
(This lurker has not posted anything to this message
board so Mr. Anthony has no idea who she is.)
P.S.S. Given Mr. Anthony's threats to sue Mikey, maybe
we should start a message board pool on which we bet
who the next two people Mr. Anthony will sue next.
I will place a bet on Mikey. :-) :-)</HTML>
